Businesses
Defamation happens when someone makes a statement that causes damages or injures the reputation of another person. It is also known as slander or libel. In Malaysia, three (3) criteria must be fulfilled before defamation is proven:
- There must be a statement that is defamatory
- The statement must refer to or identify the claimant [person being defamed]
- The statement must be published to a third party other than the person being defamed
If your review expresses your honest opinion and the individual is not identifiable, you are not obligated to remove your review. Sometimes, even if the name of the person is not disclosed but the person is identifiable e.g., “The Managing Director of ABC is conducting insider trading”, disclosed to a third party and you can prove it then it is considered as defamation.
When it comes to reviews, you need to keep in mind the following:
- People typically leave only one review, be it positive or negative.
- Businesses may have encouraged their customers to leave a review by email or social media.
Having said that, if you still suspect that a review has breached the Review Guidelines, do report it to us at hello@100comments.com.
